Comparative Study on Transfer of Land Ownership in Japan and Finland:
Requirements for Transfer of Ownership, Double Transaction, Protection
against False Registration Information and Land Use Rights
This article compares Japanese law and Finnish law concerning the system of
transfer of land ownership. It specifically examines related topical issues
in Japanese law, such as requirements of transfer of land ownership, double
transactions, protection of a trusting third party against false
registration information as well as the protection of land use rights. In
addition, this article presents the progress of the Finnish land law from
medieval times to its reform in 1995 and creation of the online conveyance
system in 2013, including the underlying principles and theory of the land
law. In Finland, the kind of land ownership transfer issues which have been
discussed intensively in Japan, are governed by specific legal rules.
Comparing Finnish and Japanese law provides important insights into the
discussion of transfer of ownership according to Japanese law.
