Ein kulturgerechtes Verstehen von Recht setzt voraus, dass es in seiner Kulturgebundenheit erfasst wird. So ist für den Fachfremdsprachenunterricht Rechtsdeutsch ein wissens- und performanzbezogener Ansatz entwickelt worden, der es ermöglicht, in systematischen Interpretationen von Rechtstexten kulturelles Wissen zu erwerben. Damit wird ein Desiderat hinsichtlich einer theoriebasierten Methode sowohl in der beruflichen Praxis als auch in den Rechtswissenschaften behoben, kulturelle Dimensionen in Verständigungsarbeit im Rechts systematisch mit einzubeziehen. Um diesen kulturwissenschaftlichen Ansatz auch rechtsimmanent als rationales und vernünftiges Verfahren rechtfertigen zu können, soll er rechtstheoretisch verankert werden. Dazu wird unter geltungstheoretischem Aspekt auf das universale Auditorium der Neuen Rhetorik Bezug genommen. Wesentlich geht es dabei um die Operationalisierung des universalen Publikums für ein Verfahren von rationaler Geltungskonstitution im Recht. Auf dieser theoretischen Grundlagesoll die Anschließbarkeit des Kulturansatzes an das Perelmansche Auditoriumskonzept von Rationalität und Vernünftigkeit dargestellt werden.

A culturally adequate understanding of the law has to recognize and involve the cultural nature of legal matters. Therefore, a knowledge- and performance-related method has been developed for teaching legal German as a foreign language. This method derives from cultural studies and allows for obtaining cultural knowledge through systematic exploration of legal texts. Thus, this approach responds to the desideratum of a theory-based method to integrate cultural dimensions when reaching an understanding the law that is relevant for legal practice as well as legal studies. To justify this interdisciplinary approach as a rational and reasonable procedure for legal studies, it will be embedded into legal theory by referring to the concept of the universal audience of the New Rhetoric. In the following, the concept of Perelman’s universal audience is presented in respect to rational argumentation. The focus will be on the operationalization of the universal audience as a procedure for constituting validity in law. On the basis of this theoretical ground, the connectability of the cultural approach to Perelman’s audience as a concept of the rational and the reasonable can be developed.
