I am an enthusiast patent law and emerging technologies researcher with a keen interest in patent law, artificial intelligence and pharmaceutical drug development. I am committed to advancing the understanding and application of patent legal frameworks in the rapidly evolving landscape of emerging technologies.



Tutkimus

My research examines the challenges associated with the level and quality of human contribution needed to qualify as an inventor in the context of AI-assisted inventions like drugs. Currently, it is generally acknowledged that AI cannot be an inventor under patent law. Yet, it is considered a potential contributor to the creation of an invention. In such situations, humans must make an influential contribution to the inventive process to be named the inventor and for the invention to be patent-able. The challenge is that there is no clarity on what constitutes a significant or insignificant human contribution to satisfy the inventive contribution in the context of AI-assisted inventions. Considering this conundrum, the research employs black-letter law and theories of patent law to examine the appropriate of quality of human contribution needed in the context of AI-assisted drugs. This research is important because the lack of clarity on what amounts to creative contribution can lead to invalidity claims for AI-assisted inventions and “inventor-less” situations. Also, a lack of clarity on this issue could lead to over or under rewarding inventors and this might diminish trust in the patent law system.
